These Terms constitute a legally binding agreement between you and OpenCan.ai ("Company," "we," "us," or "our") governing your use of our AI-powered assistant platform.
2. Service Description
OpenCan.ai provides an AI assistant platform that offers:
- Conversational AI powered by large language models
- Image generation capabilities
- Video generation capabilities
- Text-to-speech synthesis
- Web search integration
- Vision/image understanding
The Service utilizes various AI models, including Meta's Llama models, and is subject to both our policies and the usage requirements of underlying model providers.
3. Eligibility
You must be at least 13 years of age to use this Service. If you are between 13 and 18 years of age, you must have parental or guardian consent to use the Service.
By using the Service, you represent and warrant that you meet these eligibility requirements.
4. User Accounts
Some features may require account registration. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
5. Acceptable Use Policy

Our Service uses Meta's Llama AI models, which are subject to Meta's Acceptable Use Policy. By using our Service, you also agree to comply with Meta's usage requirements as outlined in Section 6 below.
6. Prohibited Uses
You agree NOT to use the Service to:
6.1 Illegal Activities
- Violate any applicable laws, regulations, or third-party rights
- Engage in, promote, or facilitate illegal activities
- Generate content that violates any person's legal rights
6.2 Harmful Content
- Generate content that exploits, harms, or endangers minors
- Create, distribute, or facilitate child sexual abuse material (CSAM)
- Produce content depicting violence against specific individuals
- Generate content promoting self-harm, suicide, or eating disorders
- Create content that harasses, bullies, or threatens individuals
6.3 Deception & Misinformation
- Generate false information intended to deceive or harm others
- Create deepfakes or synthetic media to mislead
- Impersonate individuals or organizations fraudulently
- Spread disinformation or propaganda
- Manipulate public opinion through coordinated inauthentic behavior
6.4 Discrimination & Hate
- Generate content promoting discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
- Create hate speech or content inciting violence against groups
- Facilitate discriminatory practices in employment, housing, credit, or other domains
6.5 Dangerous Activities
- Generate instructions for weapons, explosives, or dangerous materials
- Create content facilitating terrorism or violent extremism
- Produce malware, viruses, or other harmful code
- Facilitate cyberattacks or unauthorized system access
6.6 Regulated Industries (Without Proper Oversight)
- Provide medical diagnoses or treatment recommendations without appropriate disclaimers and professional oversight
- Offer legal advice as a substitute for licensed attorneys
- Give financial advice that should come from licensed professionals
- Make decisions in high-stakes domains (healthcare, criminal justice, employment) without human oversight
6.7 Privacy Violations
- Collect, process, or share personal data without consent
- Generate content revealing private information about individuals
- Use the Service for surveillance or tracking individuals
- Attempt to re-identify anonymized data
6.8 Spam & Manipulation
- Generate spam, unsolicited messages, or automated bulk content
- Manipulate or game platform systems
- Create fake reviews, testimonials, or engagement
- Use automated systems to overload or disrupt the Service
6.9 Intellectual Property Violations
- Generate content that infringes copyrights, trademarks, or other IP rights
- Reproduce substantial portions of copyrighted works
- Create counterfeit goods or fraudulent materials
ℹ️ Meta Llama Community License
The AI models powering parts of this Service are licensed under Meta's Llama Community License Agreement. Users with more than 700 million monthly active users must request a separate license from Meta. For more information, visit llama.meta.com.
7. AI Limitations & Disclaimers
7.1 No Guarantee of Accuracy
AI-generated content may contain errors, inaccuracies, or outdated information. The Service is provided "as is" without warranties of accuracy, completeness, or reliability.
7.2 Not Professional Advice
AI responses do NOT constitute professional advice. Always consult qualified professionals for:
- Medical, health, or mental health issues
- Legal matters
- Financial or investment decisions
- Any situation with significant consequences
7.3 Human Oversight Required
AI outputs should be reviewed by humans before use in any important context. You are solely responsible for verifying information and making final decisions.
7.4 Generated Content Ownership
Subject to these Terms and applicable laws, you may use AI-generated content for lawful purposes. However, you acknowledge that:
- Similar content may be generated for other users
- We make no guarantees of uniqueness or exclusivity
- You are responsible for ensuring your use doesn't infringe others' rights
8. Intellectual Property
The Service, including its design, features, and content (excluding user-generated content), is owned by OpenCan.ai and protected by intellectual property laws.
You retain ownership of content you input into the Service, subject to our license to process and respond to your requests.
9. Third-Party Services
The Service may integrate with or link to third-party services. We are not responsible for third-party content, privacy practices, or availability.
Our Service incorporates technology from various providers, including:
- Meta (Llama language models)
- Other open-source AI model providers
- Search and data providers
10. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms.
Upon termination:
- Your right to use the Service ceases immediately
- We may delete your account and associated data
- Provisions that should survive termination will remain in effect
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
- WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED
- WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (OR $100 IF YOU HAVEN'T PAID ANYTHING)
12. Indemnification
You agree to indemnify, defend, and hold harmless OpenCan.ai and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you generate or share using the Service
13. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated through the Service or via email. Continued use after changes constitutes acceptance of the modified Terms.

Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, United States, without regard to conflict of law principles.
